General Terms and Conditions of the Online Shop of Pet Fun – legally represented by Thorsten Sievers

The following terms and conditions are written in German and can be downloaded to the customer's computer and printed out. Upon request, they can be requested in digital or written form at the email address kratzbaum@petfun.de. They will also be displayed to the customer when placing their order.

The address of Pet Fun for service of process can be found on the invoice.

 

Preamble

Pet Fun operates a website for commercial purposes under the domain https://www.petfun.de. Pet Fun offers customers products, mainly cat scratching posts and toys, for purchase via the Internet on these websites.

 

§ 1 Product selection

The customer has the option of selecting and ordering products on the above-mentioned website. The customer receives a separate product description for each product on the respective website.

The customer can click on the products they want on the website. These are collected in a virtual shopping cart and at the end of their purchase, the customer receives a summary of the products with the total final price including VAT.

Before sending the order, Pet Fun allows the customer to check the order for accuracy, in particular the price and quantity, and to correct it if necessary.

 

§ 2 Cancellation and return policy

Right of withdrawal

You may revoke your contractual declaration within two weeks without stating reasons in writing (e.g., letter, fax, email) or—if the item is delivered to you before the deadline expires—by returning the item. The period begins upon receipt of this notification in writing. To comply with the revocation period, it is sufficient to send the revocation or the item in good time.

Consequences of revocation

In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g., interest) must be surrendered. If you are unable to return the service received in whole or in part, or only in a deteriorated condition, you may be required to compensate us for the loss in value. This does not apply to the surrender of goods if the deterioration of the goods is exclusively attributable to their inspection—as would have been possible in a retail store, for example. Otherwise, you can avoid the obligation to pay compensation for any deterioration caused by the intended use of the item by not using the item as your property and refraining from anything that could impair its value. Items that can be shipped by parcel post are to be returned at our expense and risk. We cannot accept shipments that are not prepaid. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation declaration or the item, and for us with its receipt.

 

Special notes

The right of withdrawal does not apply to contracts for the delivery of goods that are manufactured according to customer specifications or clearly tailored to personal needs.

Right of return

You may return the goods received without giving reasons within two weeks by returning the goods. The period begins after receipt of this instruction in writing, but not before receipt of the goods. Only in the case of goods that cannot be shipped by parcel post (e.g., bulky goods) can you also declare the return by requesting the return in writing. To meet the deadline, it is sufficient to send the goods or the return request in good time. In any case, the return shipment is at our expense and risk.

Compensation for lost value may be demanded if the goods have deteriorated. This does not apply if the deterioration of the goods is exclusively attributable to their inspection—as would have been possible in a retail store, for example. Furthermore, you can avoid the obligation to pay compensation for deterioration caused by the intended use of the item by not using the goods as your property and refraining from anything that could impair their value. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of the goods or the request for return, for us with the receipt.

§ 3 Prices

The list prices valid at the time of ordering, as shown on the website, apply. Prices are quoted ex Pet Fun's place of business, including VAT, excluding packaging and shipping costs.

 

§ 4 Conclusion of contract

The offers made by Pet Fun on the website are subject to change. Pet Fun is therefore not obliged to perform in the event of unavailability. However, a contract is concluded and thus a contractual obligation regarding the individual services comes into effect once Pet Fun has confirmed the customer's order in writing. Pet Fun is entitled to deliver goods of equivalent quality and price in consultation with the customer if the goods ordered are not available.

 

§ 5 Execution of the contract

Processing of orders

Pet Fun will process orders without delay, subject to operational capabilities, and inform the customer whether the desired products are available.

 

Delivery

If the ordered products are available, Pet Fun will deliver them within a maximum of 10 working days after receipt of the order.

 

Shipping costs within Germany

Shipping costs for purchases up to €95: €7

Shipping costs for purchases over €95: €14.95

 

Changes, additions, and limitations to the order


Pet Fun will respond promptly to customer requests regarding changes, additions, and/or limitations to the scope of products in orders that have already been placed. If the customer requests a product change, addition, and/or limitation prior to the planned delivery, Pet Fun will take this into account as far as possible.

 

§ 6 Service hotline

Pet Fun provides a hotline for customer questions relating to the products. This hotline is available to the customer except on Thursdays from 9:00 a.m. to 3:00 p.m.

 

§ 7 Terms of payment

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. Payment is made to Klarna:

  • Invoice: The payment term is 14 days from dispatch of the goods/ticket/or, in the case of other services, from provision of the service. The invoice terms and conditions can be found here
  • Installment purchase: With Klarna's financing service, you can pay for your purchase flexibly in monthly installments of at least 1/24 of the total amount (but at least EUR 6.95) or under the conditions otherwise specified at checkout. The installment payment is due at the end of each month after Klarna has sent a monthly invoice.   • Instant: Your account will be debited immediately after placing your order.
  • Credit card (Visa/Mastercard)
  • Direct debit: The debit will be made after the goods have been shipped. You will be notified of the date by email.

The use of the payment methods invoice, installment purchase, and direct debit requires a positive credit check. In this respect, we forward your data to Klarna for the purpose of address and credit checks as part of the initiation and processing of the purchase contract. Please understand that we can only offer you those payment methods that are permitted based on the results of the credit check. Further information and Klarna's terms of use can be found here. Your personal data will be treated by Klarna in accordance with the applicable data protection regulations and in accordance with the information in Klarna's privacy policy.

 

§ 8 Warranty and liability

The customer shall notify Pet Fun of any defects in the product and shall also send the product to Pet Fun at Pet Fun's expense.

The provider's warranty is based on §§ 433 ff. BGB (German Civil Code). In commercial business transactions, the warranty is limited to one year and Pet Fun is entitled to repair the product or provide a replacement free of charge at its discretion.

Pet Fun shall be liable

  • for the full amount of damages in the event of gross negligence on the part of its organs and executive employees,
  • on the merits in the event of any culpable breach of essential contractual obligations,
  • outside such obligations, on the merits, also for gross negligence on the part of simple vicarious agents, unless Pet Fun can exempt itself from this by virtue of commercial practice,
  • in the last two case groups, for compensation for the typical foreseeable damage.

Any contributory negligence on the part of the customer shall be taken into account.

Liability for intent, warranty, malice, and personal injury, as well as under the Product Liability Act, remains unaffected by this.

§ 9 Force majeure

In the event that Pet Fun is unable to perform the service owed due to force majeure (in particular war, natural disasters), it shall be released from its performance obligations for the duration of the hindrance.

If Pet Fun is unable to execute the order or deliver the goods for more than one month due to force majeure, the customer is entitled to withdraw from the contract.

 

§ 10 Data protection

Pet Fun will comply with all data protection requirements, in particular the provisions of the Telemedia Act.

 

§ 11 Final provisions

The contract language is German.

Should any provision of these terms and conditions be or become invalid, the remaining provisions shall remain valid. Pet Fun and the customer shall replace the invalid provision with a valid provision that comes as close as possible to the economic intent of the contracting parties.

Packaging Ordinance:

In accordance with the provisions of the Packaging Ordinance, we are obliged to take back used, empty sales packaging that cannot be disposed of via an established comprehensive disposal system – currently including: Der Grüne Punkt - Duales System Deutschland GmbH, INTERSEROH AG for the recycling of secondary raw materials, and Landbell AG - must be disposed of free of charge at your premises or in your immediate vicinity and ensure that it is reused and disposed of. We will inform you of a municipal collection point or a waste disposal company in your area or in your
immediate vicinity that will accept the packaging free of charge.
If this is not possible, you have the option of returning the packaging to us free of charge using the above
contact details. The packaging will be reused by us
or disposed of in accordance with the provisions of the VerpackV (German Packaging Ordinance).
